The GrailCoat Company, LLC guarantees that its SuperFlex, DuraFlex, or DuraSurf System will provide a waterproof barrier that will not crack or delaminate for a period of twenty years from the date of application when installed according to GrailCoat’s current instructions. This warranty is invalidated if failure is caused by misuse, faulty design, structural failure, improper application, deviation from specifications, failure of the substrate, or other circumstances beyond the control of The GrailCoat Company, LLC, which will in no event be liable for incidental or consequential damages. In no event shall GrailCoat’s liability, if any, extend beyond the purchase price of the material. No other expressed or implied warranty is extended for any GrailCoat product other than that set out above.

This warranty is governed by the law of the State of Florida. Any claim that this warranty has been breached shall first be brought to the attention of The GrailCoat Company, LLC in writing at the address set out below. Any such claim which cannot be resolved amicably shall then be submitted to binding arbitration before a single arbitrator under the auspices of the American Arbitration Association, to be conducted in Daytona Beach, Florida.
